Ferguson and Day Receive Prison Time; Two Plead Guilty to Felony Assault in June 2008 Incident

Sentencing has been handed down for two of the four individuals arrested in conjunction with the June 18, 2008 incident that resulted in the death of 20-year-old Mike Lundin and injuries to two other, unnamed young men from Big Bear. The two men charged with felony assault had both pleaded guilty and, just before the Fourth of July holiday, were sentenced to state prison. Both David Ferguson, now age 20, and Christopher Day, 19, were given two consecutive two-year terms for the assault charge plus others but, given time already served and appropriate conduct, the two each have (as of sentencing) 165 days left to serve at, now, the California Department of Corrections at Chino. Both Ferguson and Day are also ordered to pay $7,500 restitution each. Nineteen-year-old Mark Potts, the first to plead guilty to the assault charge, has since completed his time in custody. The fourth individual arrested in the June 2008 incident is 20-year-old Chalen Winters of Big Bear Lake; Winters was 18 at the time of his arrest for the charge of murder. He had been scheduled for a preliminary hearing in June but, given a defense motion for continuance, will instead have his next court appearance at July’s end. Update: As of June 2010, defendant Chalen Winters remains in custody, and is scheduled for a jury trial on September 20, 2010.
